Amending and supplementing regulations on certification of aromatic rice varieties exported to the European Union (01/17/2022)
On January 15, the Government has just issued Decree No. 11/2022/ND-CP amending and supplementing a number of articles of Decree No. 103/2020/ND-CP on certification of aromatic rice varieties exported to the Union European Union to guide the implementation of certification of aromatic rice varieties for export to the European Union and the United Kingdom of Great Britain and Northern Ireland.

Accordingly, Decree 11 amends and supplements "Scope of regulation" as follows: This Decree stipulates the certification of fragrant rice varieties on the List specified at Point 8 subsection 1 Section B Appendix 2-A of the Free Trade Agreement between Vietnam and the European Union (abbreviated as the EVFTA Agreement) are entitled to quota-based import tax exemption when exporting to the European Union within the framework of the EVFTA Agreement and exporting to the EU. United Kingdom of Great Britain and Northern Ireland (UK) within the framework of the Free Trade Agreement between Vietnam and the United Kingdom of Great Britain and Northern Ireland (abbreviated as the UKVFTA Agreement).
Decree 11 amends the regulations on "Dossier of application for certification of aromatic rice varieties" as follows: The form of re-certification of aromatic rice varieties must be fully declared from items 1 to 9 according to the form specified in Appendix 1. Appendix VII issued together with Decree No. 103/2020/ND-CP for fragrant rice exported to the EU or Appendix VIIa issued together with this Decree for fragrant rice exported to the United Kingdom of Great Britain and Northern Ireland .

Regarding the order of certification of aromatic rice varieties, the decree states: Within 5 working days from the date of receipt of valid dossiers, the Department of Crop Production will appraise and certify in section 10 of the certificate form. receive the type of fragrant rice specified in Appendix VI issued with Decree No. 103/2020/ND-CP for fragrant rice exported to the EU or Appendix VIa issued together with this Decree for fragrant rice exported to the UK; In case of non-certification, a written reply must be given clearly stating the reason.
In addition, Decree 11 also amends the regulations on "Responsibility of the Department of Crop Production" as follows: Publishing on the web portal of the Department of Crop Production, the Ministry of Agriculture and Rural Development a list of testing organizations ; the name of the organization or individual that has been granted or canceled the certificate of aromatic rice varieties; The list of aromatic rice varieties exported to the EU is updated, amended and supplemented according to the decision of the Trade Committee of the EVFTA Agreement; The list of fragrant rice exported to the UK is updated, amended and supplemented according to the Decision of the UKVFTA Trade Committee.

At the same time, Decree 11 supplements appendices VIa, VIIa issued together with this Decree; replace Appendix V issued together with Decree No. 103/2020/ND-CP with Appendix V issued together with this Decree; Annex I promulgated together with Decree No. 103/2020/ND-CP is annulled.
