Accordingly, Vietnam is not subject to safeguard duty because it is in the group of developing countries that are excluded due to the insignificant import volume. The safeguard duty will take effect within three (03) years from the date the Philippine Customs Authority issues an order to collect the tax. The rates of safeguard tax over the years are as follows: Php 1,338/MT for the first year; 1,271 Php/MT for the second year; and 1,208 Php/MT for the final year. However, DTI may conduct a review to adjust the tax rate or list of excluded countries if imports from these countries increase.
