Completing regulations on management of e-commerce activities via mobile applications (01/20/2022)
On January 18, the Ministry of Industry and Trade issued a Circular amending and supplementing a number of articles of Circular No. 47/2014/TT-BCT (Circular No. 47) dated December 5, 2014 of the Ministry of Industry and Trade providing on management of e-commerce websites and Circular No. 59/2015/TT-BCT dated December 31, 2015 of the Ministry of Industry and Trade regulating the management of e-commerce activities via applications on mobile devices

Specifically, Circular 47 will amend and supplement Article 5 as follows: Principles of notification and registration of e-commerce websites. Accordingly, traders and organizations that own e-commerce websites that have the function of selling goods and providing e-commerce services only carry out registration procedures with the Ministry of Industry and Trade according to the provisions of Chapter II of this Circular.
The Circular also mentions amending and supplementing the name of Chapter II: Procedures for notification, registration of e-commerce website and registration of service provision of e-contract authentication.

Amending and supplementing Article 20 specifically: Reporting methods by traders and organizations that have registered e-commerce service provision websites.

Traders and organizations that set up websites to provide e-commerce services shall report to the Ministry of Industry and Trade the statistics on the previous year's operations by online method through the Commercial Operations Management Portal. electronically or in writing by post.
Notably, supplementing Article 20a under Article 20 in Chapter II on provision of e-contract authentication services, including: Regulations on provision of e-contract authentication services must be publicly announced on the Internet. homepage of the website and include the following contents: Rights and obligations of traders and service providers; Rights and obligations of service users; Describe the method and process of performing electronic contract authentication; Limiting the liability of traders and organizations providing e-contract authentication services; Regulations on information security and information management in providing e-contract authentication services; Mechanism for settling complaints and disputes between parties related to the provision of e-contract authentication services; Measures to handle violations for those who do not comply with the operating regulations

When there is a change in one of the contents mentioned in Clause 1 of this Article, the trader or organization providing the e-contract authentication service must notify all service users at least 5 days in advance. when applying those changes."
In addition, the Circular also adds Article 28a after Article 28: Article 28a announces the list of market leading enterprises in the field of e-commerce services. Accordingly, before March 15 every year, the Ministry of Industry and Trade announces the group of 05 leading enterprises in the market of the previous year.

Supplementing Article 29a after Article 29: Article 29a publishes a list of traders and organizations providing e-contract authentication services that have carried out registration procedures.

The list of traders and organizations providing e-contract authentication services that have completed registration procedures and received certification from the Ministry of Industry and Trade is publicly announced on the e-commerce management portal.

This Circular takes effect from March 8, 2022. During the implementation of this Circular, if any problems arise, relevant traders or organizations and individuals shall promptly report them to the Ministry of Industry and Trade. to be considered and processed.
