Warning of 10 export products at risk of trade remedy lawsuits (08/20/2021)
The Trade Remedies Administration (Ministry of Industry and Trade) has just updated a warning list of 10 products at risk of being subject to measures to combat evasion, origin fraud, illegal transshipment or trade remedies.

Notably, all 10 products on the warning list face risks in the major export market, the US; including three products of wood products.

Specifically, from January to May, the watch list includes 10 items including plywood items from hardwood materials, wooden cabinets, sofas with wooden frames, artificial stone, ceramic tiles, electric bicycles , copper pipes, gas cylinder covers, barrel pins, wood bars and strip edges are shaped continuously.

Among them, plywood products from hardwood plywood exported to the US need to be very careful because Vietnam's export turnover to the US increased rapidly from 33.4 million USD in 2016 to 322.2. million USD in 2019.

In October 2020, the US Trade Representative (USTR) announced that it had initiated an investigation into the import and use of raw materials illegally harvested and traded in Vietnam.

In addition, sofas with wooden frames, upholstered, wooden cabinets and vanities, and ceramic tiles exported to the United States are also at risk of large packages when exporting. to this market.

Specifically, Vietnam's ceramic tile exports to the US are on a growing trend, from $269,000 in 2018 to $2.8 million in 2019.

In the period from June 2020 to May 2021, Vietnam's turnover reached 20.6 million USD, although the proportion of imports from Vietnam in total US imports accounted for only 1.1%.

However, the US officially applied anti-dumping and anti-subsidy taxes on similar products imported from China since April 2020.

Therefore, it is forecasted that Vietnam's ceramic tile exports to the US market will continue to increase rapidly in the coming period in the context of China's ceramic tile exports plummeting due to the imposition of anti-dumping and anti-subsidy taxes.

Therefore, the Trade Remedies Department recommends monitoring the issuance of certificates of origin and declaration of origin and continuing to monitor the risk of anti-tax evasion investigation and trade remedies for imported goods. this item.

On the other hand, electric bicycles are also facing many risks in both the US and the EU when Vietnam's export turnover to the EU increased from 74 million euros in 2018 to 87.5 million euros in 2019 and slightly decreased to 83. 6 million euros in 2020.

In the period from June 2020 to May 2021 alone, Vietnam's export turnover to the US reached 30.4 million USD, up 30.4% over the same period last year.

The European Bicycle Manufacturers Association expressed concern about a Chinese enterprise showing signs of fraud of Vietnamese origin to evade EU trade remedies applied to Chinese products. .

Over the past time, through enhanced inspection and supervision, Vietnamese authorities have prevented a number of cases where enterprises have incorrectly declared the origin of electric bicycle products, so they need to continue to include them in the list of e-bikes. warning book.

In addition, continuously shaped timber bars and strips (Wood moldings, millwork products) exported to the US, HS codes for reference: 4409.10, 4409.22, 4409.29 have also been added to the warning book.

According to the Trade Remedies Department, Vietnam's export turnover has shown signs of increasing since November 2020.

In the period from June 2020 to May 2021, Vietnam's export turnover reached 13.6 million USD, up 315.6% over the same period last year. Imports from Vietnam accounted for 1.42% of total US imports.

Although Vietnam's share in total US imports is still low, the US has applied anti-dumping and anti-subsidy measures on similar Chinese products from December 2020 with a relatively high tax rate. (the lowest anti-dumping tax is 33.87%, the lowest anti-subsidy tax is 20.56%).

Therefore, it is necessary to monitor the issuance of certificates of origin and declaration of origin for this item to prevent possible frauds in order to benefit from tax differences.
